Effective August 18, 2026. Plain-language terms for using this site and working with us.
These Terms govern your use of aits.llc, the AI Risk Scan, and any services provided by NGD Enterprises LLC DBA AITS ("AITS," "we," "us"). By using the site or our services, you agree to them. If you do not agree, please do not use the site.
Who may use this site
This site is intended for businesses and for people aged 16 or older. By using it you confirm you have the authority to act for the business you are inquiring about.
The AI Risk Scan
The scan may reference regulatory frameworks such as HIPAA, PCI-DSS, CMMC, CJIS, or COPPA. Those references are general context to help you decide what to look into — they are not a determination of whether your business complies with any law or standard, and they must not be relied on as one. Only a qualified attorney, auditor, or compliance professional can assess your obligations.
Results depend on the accuracy of what you enter. Part of the report is generated with automated tools, including AI, which can be incomplete or wrong. Do not make legal, financial, or security decisions on the report alone.
Services, quotes and fees
Prices shown on this site are starting points, not offers or quotes. Actual scope and price are set in a written proposal or service agreement. If those documents conflict with this page, the signed agreement controls.
Monthly services are month-to-month unless agreed otherwise. Third-party costs — software subscriptions, telecom and messaging fees, domain registration, advertising spend, payment processing — are separate from our fees unless a written agreement says they are included.
Your responsibilities
- Provide accurate information and timely access to systems we need.
- Hold the rights to any content, brand assets, or data you give us to use.
- Maintain ownership of your own domains, payment accounts, and business records.
- Use anything we build lawfully, including messaging and marketing laws.
Messaging and communications
If you give us your phone number and check the SMS consent box, you agree to receive text messages as described at the point of consent and in our Privacy Policy. Consent is never a condition of any purchase. Reply STOP to opt out or HELP for help. Message and data rates may apply.
Intellectual property
The site, its content, and the AITS name and marks belong to us. Work product we create specifically for you transfers as set out in your service agreement. We keep ownership of our own methods, templates, configurations, and reusable components, and may continue to use general knowledge and experience gained while working with you.
Third-party services
Our work often connects to services we do not control — hosting, payment processors, messaging carriers, calendars, and other platforms. We are not responsible for their outages, policy changes, pricing, rate limits, account suspensions, or defects. Where a third party requires you to accept its own terms, those terms apply between you and them.
Disclaimers
The site and the scan are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that any result described on this site will be achieved for your business.
Limitation of liability
To the fullest extent permitted by law, AITS is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity, arising from your use of this site or the scan. Our total liability relating to the site or the scan will not exceed one hundred dollars ($100). Liability arising from paid services is governed by the applicable service agreement.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold AITS harmless from claims arising out of information you provide, content or data you ask us to use, your use of anything we build, or your violation of these Terms or applicable law.
Termination
We may suspend or end access to the site or the scan at any time, including for misuse. Termination of paid services is governed by your service agreement.
Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute relating to the site or the scan will be brought in the state or federal courts located in San Diego County, California, and you consent to that venue.
Changes
We may update these Terms. Changes take effect when posted, and the effective date above will be revised. Continued use of the site after a change means you accept the updated Terms.
